This Privacy Policy applies to personal data processed through the website www.lesile.com and all of its associated pages and sub-domains (the “Site”), through orders placed on the Site, and through communications with Lesile by email or any other channel.

This Privacy Policy does not apply to websites or services of third parties, including payment providers and carriers, which have their own privacy policies (see Section 6).

3.2 Health-related information (allergies)

Our General Terms & Conditions invite Customers with severe allergies to contact us before placing an order. If you choose to share information about an allergy or food intolerance with us, this constitutes data concerning health within the meaning of Article 9 GDPR. We process such information only on the basis of your explicit consent, solely to answer your enquiry, and we delete it once your enquiry has been handled. Providing this information is entirely voluntary and is never required to place an order.

3.3 Personal data collected automatically

When you visit the Site, certain technical data is collected automatically, such as your IP address, browser type and version, device type, operating system, the pages visited and the date and time of your visit. This data is processed in server logs for the security and proper functioning of the Site and through strictly necessary cookies (see Section 5).

Lesile does not use analytics, advertising or social media tracking tools (such as tracking pixels) on the Site.

3.4 Personal data we receive from third parties

  • Klarna: where you choose to pay with Klarna, confirmation of whether your payment has been approved. Credit assessments are carried out by Klarna, not by Lesile.
  • Carriers: delivery status and tracking information, and information about failed or completed delivery attempts.

We process your personal data only for specified purposes and on one of the legal bases provided in Article 6 GDPR:

4.1 Processing and delivering your order

To accept and confirm your order, prepare and ship your products, provide tracking information, and inform you about the status of your order or any delay or unavailability. Legal basis: performance of a contract (Article 6(1)(b) GDPR).

4.2 Payment and order verification

To process your payment through our payment providers and, where necessary, to verify payments and prevent fraud, unauthorised use of payment methods, unauthorised resale or abuse of the Site, as described in our General Terms & Conditions and Payment Policy. Legal basis: performance of a contract (Article 6(1)(b) GDPR) and our legitimate interest in protecting Lesile and its Customers against fraud (Article 6(1)(f) GDPR).

4.5 Newsletter

To send you our newsletter and other marketing communications, but only where you have actively subscribed. You may withdraw your consent at any time by clicking the unsubscribe link in any email or by contacting hello@lesile.com. 4.6 Legal, accounting and tax obligations

To issue invoices, keep accounting records and comply with our obligations under Belgian accounting, tax and VAT legislation, and to respond to lawful requests from competent authorities. Legal basis: compliance with legal obligations (Article 6(1)(c) GDPR).

4.7 Food safety and product recalls

Where a product sold by Lesile is subject to a safety warning or recall, to contact the Customers concerned. 4.8 Security of the Site and legal claims

To ensure the security and proper functioning of the Site, to detect and prevent unauthorised access, and to establish, exercise or defend legal claims. Legal basis: our legitimate interests (Article 6(1)(f) GDPR).

Where we rely on our legitimate interests, we have balanced those interests against your rights and freedoms. You have the right to object to such processing at any time (see Section 10).

Providing your identity, contact, delivery and payment data is necessary to conclude and perform a contract with you. If you do not provide this data, we will not be able to process your order. Lesile does not make decisions based solely on automated processing, including profiling, which produce legal effects concerning you or similarly significantly affect you.

5. Cookies

Cookies are small text files placed on your device when you visit a website. The Site uses only strictly necessary cookies, which are essential for the Site to function and for you to use its features, such as keeping products in your shopping basket, completing the checkout process, logging into your customer account and keeping the Site secure. These cookies do not require your consent under Belgian law.

Strictly necessary cookies used on the Site include, in particular:

  • WooCommerce cookies (such as woocommerce_cart_hash, woocommerce_items_in_cart and wp_woocommerce_session_): used to remember the contents of your shopping basket and your session. Duration: session to 48 hours.
  • WordPress cookies (such as wordpress_logged_in_ and wordpress_sec_): used only if you log into a customer account, to keep you logged in securely. Duration: session or up to 14 days if you choose “Remember me”.
  • Payment provider cookies: placed by Stripe (such as __stripe_mid and __stripe_sid), Mollie, PayPal or Klarna, used to process payments securely and to prevent fraud. Duration: session to 1 year.

Lesile does not use analytics, advertising or social media cookies. If we decide to introduce such cookies in the future, we will request your prior consent through a cookie banner and update this Privacy Policy and our Cookie Policy accordingly.

You can delete or block cookies through your browser settings. Please note that blocking strictly necessary cookies may prevent you from placing an order on the Site.

6. Who We Share Your Personal Data With

Lesile does not sell, rent or trade your personal data. We share your personal data only with the following categories of recipients, and only to the extent necessary for the purposes described in this Privacy Policy:

  • Carriers: bpost and UPS, which receive your name, delivery address, telephone number and email address in order to deliver your order and provide tracking information.
  • Payment providers: Stripe and Mollie, which process card payments and the other payment methods offered on the Site (including iDEAL, Bancontact, SOFORT, Apple Pay and Google Pay), as well as PayPal and Klarna. These providers receive the data necessary to process your payment and act as independent controllers for their own processing, including fraud prevention and, in the case of Klarna, credit assessments.
  • IT and hosting providers: the provider hosting the Site and our email service provider, which process personal data on our behalf as processors under a data processing agreement in accordance with Article 28 GDPR.
  • Professional advisers: our accountant, auditors and legal advisers, where necessary for the purposes of accounting, tax compliance or legal advice, who are bound by professional confidentiality.
  • Public authorities: courts, tax authorities, the Federal Agency for the Safety of the Food Chain (AFSCA/FAVV) or other competent authorities, where we are required to do so by law.

In the event of a merger, acquisition or transfer of all or part of Lesile’s business, personal data may be transferred to the acquiring party, provided that you are informed in advance and your rights under this Privacy Policy are not adversely affected.

7. International Data Transfers

Lesile processes personal data primarily within the European Economic Area (EEA). Some of our service providers, such as UPS and Stripe, or their sub-processors may process personal data outside the EEA. Where this is the case, we ensure that the transfer is protected by appropriate safeguards, such as an adequacy decision of the European Commission (including the EU-U.S. Data Privacy Framework, where the recipient is certified) or the Standard Contractual Clauses adopted by the European Commission.

Where you place an order for delivery to a country outside the EEA, your name, delivery address and contact details must necessarily be transferred to the carriers and customs authorities in the destination country in order to deliver your order. Such transfers are necessary for the performance of the contract with you (Article 49(1)(b) GDPR).

You may request further information about these safeguards by contacting hello@lesile.com.

8. How Long We Keep Your Personal Data

We keep your personal data only for as long as necessary for the purposes for which it was collected, in particular:

  • Order, invoice and payment data: for the period required by Belgian accounting and tax legislation, currently up to ten (10) years from the end of the financial year to which the data relates.
  • Customer account data: for as long as your account remains active. You may delete your account at any time by contacting us. Accounts that have been inactive for three (3) years will be deleted, without prejudice to the retention of order and invoice data described above.
  • Customer service, withdrawal and complaint data: for as long as necessary to handle your request and thereafter until the expiry of the applicable legal limitation periods.
  • Newsletter data: until you unsubscribe or withdraw your consent. The record of your consent is kept as proof for as long as necessary to demonstrate compliance.
  • Allergy-related information: deleted once your enquiry has been handled.
  • Server log data: for a limited period, not exceeding twelve (12) months, unless required longer to investigate a security incident.
  • Data relating to suspected fraud: for as long as necessary to prevent future fraudulent orders and to establish, exercise or defend legal claims.

Once the retention period has expired, your personal data is securely deleted or anonymised.

9. How We Protect Your Personal Data

Lesile takes appropriate technical and organisational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. These measures include encrypted connections (HTTPS/TLS) on the entire Site, encrypted storage of passwords, access restricted to authorised persons on a need-to-know basis, regular software updates and backups, and the use of payment providers certified according to the PCI DSS standard.

In the event of a personal data breach likely to result in a risk to your rights and freedoms, Lesile will notify the Belgian Data Protection Authority within seventy-two (72) hours of becoming aware of it and, where the breach is likely to result in a high risk, will inform you without undue delay, in accordance with Articles 33 and 34 GDPR.

No method of transmission over the internet is completely secure. You are responsible for keeping your account password confidential and for notifying us immediately of any unauthorised use of your account.

10. Your Rights

Under the GDPR, you have the following rights regarding your personal data:

  • Right of access: to obtain confirmation of whether we process your personal data and to receive a copy of it.
  • Right to rectification: to have inaccurate or incomplete personal data corrected.
  • Right to erasure: to have your personal data deleted, unless we are required to keep it, for example under accounting or tax legislation.
  • Right to restriction: to request that we restrict the processing of your personal data in certain circumstances.
  • Right to data portability: to receive the personal data you have provided to us in a structured, commonly used and machine-readable format, and to have it transmitted to another controller.

  • Right to withdraw consent: where processing is based on your consent, to withdraw it at any time, without affecting the lawfulness of processing carried out before the withdrawal.

To exercise any of these rights, please contact us at hello@lesile.com. We will respond without undue delay and in any event within one (1) month of receipt of your request. This period may be extended by two (2) further months where necessary, taking into account the complexity and number of requests, in which case we will inform you of the extension and the reasons for it. Exercising your rights is free of charge. Where we have reasonable doubts about your identity, we may ask you for additional information to confirm it.

11. Complaints

If you believe that the processing of your personal data infringes the GDPR, we encourage you to contact us first at hello@lesile.com, so that we can try to resolve your concern.

You also have the right to lodge a complaint with the Belgian Data Protection Authority (Autorité de protection des données / Gegevensbeschermingsautoriteit), Rue de la Presse 35, 1000 Brussels, Belgium — www.dataprotectionauthority.be, or with the supervisory authority of the EU Member State in which you habitually reside or work.

12. Children

The Site and our products are intended for persons who are at least eighteen (18) years of age, as set out in our General Terms & Conditions. Lesile does not knowingly collect personal data from persons under the age of 18.
