1. Identity of the Trader

This website is operated by PS Trading SRL, a private limited company (“société à responsabilité limitée”) incorporated under Belgian law, registered with the Crossroads Bank for Enterprises (BCE/KBO) under number BE0802329461, with its registered office at Avenue de Broqueville 86, 1200 Brussels, Belgium, trading under the name “Lesile”.

Throughout these Terms and Conditions, “Lesile”, “we”, “us” and “our” refer to PS Trading SRL. “Customer” or “you” refers to any person who uses the Site or places an order.

2. Products

Lesile offers Mediterranean food products for sale through its website, including olive oil, olives, feta cheese, yoghurt and other Greek or Mediterranean products.

Due to the artisanal and agricultural nature of certain products, natural variations in colour, taste, texture or packaging may occur between batches. Such variations do not constitute defects or non-conformities provided the essential characteristics of the product are not materially affected.

Product descriptions, photographs and allergen or nutritional information are provided in accordance with Regulation (EU) No 1169/2011 on the provision of food information to consumers. Such information is based on data supplied by producers and manufacturers and is provided for guidance. Customers are encouraged to consult the product packaging upon delivery for the most current and accurate information, including ingredients, allergens, nutritional values, storage conditions and expiry dates.

Product images on the Site are for illustrative purposes only. If a product becomes unavailable after your order is confirmed, Lesile will notify you without delay and offer cancellation with a full refund.

3. Prices and Additional Charges

All prices are displayed in Euro (€) and include VAT at the applicable rate, unless otherwise stated. Delivery costs are not included and are shown separately at checkout before you confirm your order, in accordance with Article VI.45 of the Belgian Code of Economic Law and Directive 2011/83/EU.

No additional charges will be imposed on you beyond the price shown at checkout without your explicit, active consent. Pre-ticked boxes or default opt-ins for additional charges are not used on this Site.

For orders outside the EU, customs duties, import taxes or other local charges may apply and are the sole responsibility of the Customer. Lesile has no control over such charges.

Lesile reserves the right to correct obvious pricing errors at any time. Where an error affects a confirmed order, you will be notified promptly and offered cancellation with a full refund within fourteen (14) days.

4. Orders and Contract Formation

Orders are placed through the website by selecting products and completing the checkout process. Before you confirm your order, you will be shown a clear order summary including the total price inclusive of VAT and delivery costs, the main characteristics of the products, and information about your right of withdrawal, in accordance with Directive 2011/83/EU.

The contract between Lesile and the Customer is concluded at the moment Lesile sends you an order confirmation email acknowledging acceptance of your order. This email constitutes the binding agreement between the parties. Lesile recommends that you save or print this confirmation for your records.

Lesile reserves the right to refuse or cancel an order in the event of payment failure, suspected fraud, product unavailability, shipping restrictions or any other legitimate reason. In such cases, you will be notified and any amounts already paid will be refunded in full within fourteen (14) days.

If it is found that the Customer has provided incorrect data when placing an order, Lesile reserves the right to suspend its obligations until the correct data has been received.

Lesile prohibits the purchase of products for unauthorised resale. Lesile also prohibits orders placed with the intent to be shipped to a freight forwarder or any third-party service that consolidates, redirects or forwards shipments on behalf of the Customer. Any such orders will be refused and the Customer may be excluded from the Site.

In the event Lesile suspects fraudulent activity, including but not limited to providing false information, unauthorised use of payment methods, bulk or resale orders, or actions intended to abuse or exploit the Site or its services, Lesile reserves the right to: (i) block access to the Site; (ii) remove or disable associated Customer accounts; (iii) cancel any related orders or transactions; and (iv) prevent future orders from being placed.

You may request cancellation of an order before it has been dispatched by contacting us as soon as possible at hello@lesile.com. If the order has already been dispatched, please refer to our Return & Refund Policy.

5. Payment

Full details of accepted payment methods, security standards and verification procedures are set out in our Payment Policy, published on the Site. Orders are processed only once full payment has been successfully received and confirmed.

6. Delivery

Full details of delivery areas, timescales, packaging and conditions are set out in our Shipping Policy, published on the Site.

In accordance with Article VI.43 of the Belgian Code of Economic Law and Article 18 of Directive 2011/83/EU, Lesile will deliver your order without undue delay and no later than thirty (30) days from the date of the contract, unless a different delivery period has been agreed or communicated. If this deadline cannot be met, you will be notified promptly and may cancel your order for a full refund.

In accordance with Article VI.45/2 of the Belgian Code of Economic Law (in force since 21 September 2024), Lesile offers at least two delivery methods for orders delivered in Belgium, such as home delivery and delivery to a parcel locker or pick-up point. The available options are displayed at checkout.

You are responsible for providing an accurate and complete delivery address. If a delivery fails due to an incorrect address or your absence, and the order contains perishable or refrigerated products, Lesile cannot be held responsible for any resulting deterioration in product quality.

If no one is available at your address to take delivery, the carrier will follow their standard redelivery or collection procedure. If you fail to collect or rearrange delivery within a reasonable period, Lesile may cancel the order and refund the price of the products, excluding any delivery costs already incurred.

In the event of a failed first delivery attempt of refrigerated or perishable products, redelivery cannot be guaranteed. Lesile strongly recommends that customers ensure they are available to receive such orders at the time of the scheduled delivery, or that they designate a safe location or a trusted person to receive the order on their behalf.

Refrigerated orders are packed using insulated packaging and cooling elements designed to maintain appropriate temperatures for up to 48 hours from the time of delivery. Customers must refrigerate products immediately upon receipt. Lesile accepts no responsibility for deterioration resulting from failure to collect or refrigerate products promptly after delivery.

Lesile does not ship to P.O. boxes. Lesile is not responsible for delivery issues arising from incomplete, incorrect or temporary address details. Once an order has been processed, the delivery address cannot be modified.

If an ordered product is out of stock or can no longer be supplied, Lesile may cancel the order or, with your agreement, deliver a product of comparable nature and quality. In the latter case, you retain the right to cancel and return the substitute product free of charge within fourteen (14) days of delivery.

7. Transfer of Risk and Ownership

In accordance with Article VI.44 of the Belgian Code of Economic Law, the risk of loss or damage to the goods passes to the Customer at the moment the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the goods.

If the Customer arranges their own carrier independently (i.e. a carrier not offered or commissioned by Lesile), the risk passes to the Customer upon handover to that carrier.

Ownership of the goods transfers to the Customer upon full receipt of payment and physical delivery of the goods. Until full payment is received, Lesile retains ownership of all goods.

8. Right of Withdrawal

As a consumer, you have the right to withdraw from your purchase within fourteen (14) calendar days of the day you receive the goods, without providing any reason, in accordance with Article VI.47 of the Belgian Code of Economic Law and Directive 2011/83/EU.

To exercise this right, you must notify Lesile of your decision before the withdrawal period expires, by sending a clear written statement to hello@lesile.com, or by completing the Model Cancellation Form available in our Return & Refund Policy.

You must return the products within fourteen (14) days of notifying us. Returned products must be unused, unopened and in their original condition and packaging. Unless otherwise agreed, the direct cost of returning the goods is borne by the Customer.

Where a valid withdrawal is exercised, Lesile will reimburse all payments received from you, including standard delivery costs (but not any additional costs arising from your choice of a non-standard delivery method), using the same means of payment, without undue delay and no later than fourteen (14) days from receipt of the returned goods.

The right of withdrawal does not apply to: goods that are liable to deteriorate or expire rapidly; sealed goods that are not suitable for return for hygiene or health protection reasons once unsealed after delivery. This includes all refrigerated dairy products such as yoghurt, which cannot be returned once delivered, regardless of whether they have been opened.

9. Returns and Complaints Procedure

Please inspect your order immediately upon delivery. If a product is damaged, missing or incorrect, notify Lesile in writing within forty-eight (48) hours of receipt at hello@lesile.com, with a description and, where possible, photographic evidence.

For refrigerated products specifically, customers should check the condition and temperature of the products upon opening the package and must report any concerns regarding temperature or product quality within twenty-four (24) hours of delivery. Claims relating to the condition of refrigerated products submitted after this period cannot be considered, given the perishable and time-sensitive nature of such products.

Lesile will acknowledge your complaint within seven (7) working days and provide a substantive response within a reasonable period. Following review, Lesile may offer a replacement, partial or full refund, or store credit as appropriate.

All returns require prior written approval from Lesile. Full details are set out in our Return & Refund Policy.

10. Conformity and Product Liability

Lesile is responsible for any lack of conformity of products at the time of delivery. Given the perishable nature of the food products sold, conformity is assessed at the time of delivery, taking into account the nature and reasonable shelf life of each product.

Lesile warrants that products sold on the Site are of satisfactory quality and as described. This warranty applies only to products purchased directly through the Site. Products purchased from unauthorised third-party sellers are not covered by any warranty from Lesile. Lesile is not responsible for products that may be counterfeit, altered or not intended for use in your country when purchased outside of the Site. This is without prejudice to any mandatory rights you have as a consumer under applicable law.

Where a product does not conform to the contract at the time of delivery, you are entitled to an appropriate remedy, which may include replacement, a price reduction or a full refund, in accordance with applicable Belgian and EU consumer law.

From 1 January 2025, product liability for damage caused by defective products is governed by Book 6 of the Belgian Civil Code. Where a product causes damage due to a defect, Lesile and/or the producer may be liable under applicable product liability law. Customers who believe they have suffered damage caused by a product defect should contact Lesile at hello@lesile.com.

11. Allergens and Food Information

Allergen and nutritional information is provided for each product in accordance with Regulation (EU) No 1169/2011. This information is based on data supplied by producers and manufacturers. The product packaging remains the primary and most up-to-date source of food information.

Customers are responsible for reviewing allergen information before consuming any product. Lesile cannot be held responsible for allergic reactions where the Customer has failed to verify allergen information prior to consumption. Customers with severe allergies are strongly advised to contact hello@lesile.com before placing an order.

12. Storage and Handling

Customers are responsible for storing products appropriately upon delivery, in accordance with the storage instructions on the product packaging. Refrigerated products must be placed under appropriate refrigeration conditions without delay. Lesile accepts no responsibility for deterioration resulting from improper storage or handling after delivery.

In accordance with Regulation (EC) No 852/2004 on the hygiene of foodstuffs, responsibility for appropriate storage and handling of food products passes to the Customer upon delivery. The consumption of products that have been stored incorrectly, kept outside appropriate temperature conditions, or consumed after their expiry date is the sole responsibility of the Customer. Lesile’s liability ends at the point of conforming delivery.

Dairy products such as yoghurt and cheese must be kept continuously refrigerated between 2°C and 6°C. Olive oil and other shelf-stable products should be stored in a cool, dry place away from direct sunlight. Customers are responsible for following all storage instructions displayed on the product packaging.

13. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits Lesile’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, for product liability under applicable Belgian law, or for any other liability that cannot be excluded or limited under Belgian or EU law, including the mandatory rights of consumers.

Subject to the above, Lesile shall not be liable for any indirect damages, loss of profit or other consequential losses arising from the use of the Site or the purchase of products. Lesile’s total liability in connection with any single order is limited to the total value of the products purchased in that order.

Lesile is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, acts of government, strikes or disruptions to transport infrastructure. If there is a complete failure or risk of substantial delay due to such an event, you may contact Lesile to cancel the order and receive a refund for any products paid for but not received.

Without prejudice to any rights consumers may have, Lesile will only be liable for an attributable failure in the performance of an order if the Customer has notified Lesile in writing without delay, with a description of the issue in sufficient detail to allow Lesile to respond and take action. Any claim for compensation must be submitted in writing no later than thirty (30) days after the damage or loss has arisen.

14. Intellectual Property

All content on the Site — including texts, images, logos, graphics, product descriptions, designs and brand elements — is the exclusive property of Lesile or its licensors. All rights reserved. You may access and use the Site for personal, non-commercial purposes only.

You shall not: (a) reproduce, duplicate, copy, sell or otherwise exploit the Site or any of its content for any commercial purpose; (b) use any robot, spider, data mining or extraction tool to monitor, extract or copy Site content; (c) use any meta tags, search terms or keywords that contain the Site’s name or Lesile’s trademarks; (d) engage in any activity that interferes with the Site or another user’s ability to use it; (e) modify, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the Site; or (f) assist or encourage any third party to engage in any activity prohibited by these Terms and Conditions.

Lesile reserves the right to pursue all available legal remedies in such cases.

15. Personal Data

Personal data is processed by Lesile as data controller in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Belgian Act of 30 July 2018. 16. Amendments to the General Terms and Conditions

Lesile may update these Terms and Conditions at any time. Where changes are material, you will be notified by email or by prominent notice on the Site at least thirty (30) days before the changes take effect. The version in force at the time you place an order governs that order. If you do not accept the updated terms, you must stop using the Site before the changes take effect.

In the event of any conflict or inconsistency between these General Terms and Conditions and a specific agreement concluded with a Customer, the provisions of the specific agreement shall prevail.

Lesile may transfer its rights and obligations under these Terms and Conditions to another organisation, provided you are informed in advance and your rights are not adversely affected. You may only transfer your rights or obligations with our prior written consent. However, you may transfer any product guarantee to a person who has acquired the product from you, provided that person can provide reasonable evidence of ownership.

17. Governing Law and Disputes

These Terms and Conditions are governed by Belgian law, without prejudice to mandatory consumer protection provisions applicable in your country of habitual residence within the EU.

For non-consumer disputes, the competent courts of Brussels shall have exclusive jurisdiction. For consumer disputes, the courts of Brussels shall have jurisdiction, but consumers resident in another EU Member State retain the right to bring proceedings before the courts of their own country of habitual residence, in accordance with Regulation (EU) No 1215/2012.

Consumers may also use the European Commission’s online dispute resolution platform at https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is hello@lesile.com.
